In order to accomplish this purpose, we have developed this commitment by which we undertake to respect the confidentiality of your personal data and through which we explain what categories of personal data the Controller collects, how those data are used, and the purpose for which they are subject to processing operations.<\/p>\n<p>This Policy refers only to your personal data that we process through our website <a href=\"https:\/\/cristim-local.local\">www.cristim.ro<\/a>. We want to assure you that we have taken all the necessary measures to ensure the confidentiality of your data, these being processed only by the staff of the Controller, trained in the processing of personal data and authorized for this purpose.<\/p>\n<p>In order to &#8220;know&#8221; us virtually, we provide you with our identification data.<\/p>\n<p>The Controller that processes your personal data when you browse the online platform www.cristim.ro is CRIS-TIM FAMILY HOLDING S.A., based in Filipe\u015ftii de P\u0103dure village, Filipe\u015ftii de P\u0103dure commune, 661 G\u0103rii Street, Prahova County, having the Unique Registration Code 13533870, registered at the Trade Register under no. J29\/991\/2000.<\/p>\n<p>For any questions\/concerns regarding the protection of personal data, you are invited to send a request to the address indicated above or to the e-mail address <a href=\"mailto:dpo@cristim.ro\">dpo@cristim.ro<\/a>, having written on the envelope, respectively in the subject of the e-mail mentions of &#8220;Personal data protection&#8221; or &#8220;GDPR&#8221;.<\/p>\n<h2>2. Definitions<\/h2>\n<ul>\n<li>&#8220;<strong><em>Personal data<\/em><\/strong>&#8221; means, within the meaning of applicable national and international law, any information relating to an identified or identifiable natural person. An identifiable person is a person who can be identified, directly or indirectly, in particular by reference to an identification number or to one or more factors specific to his or her physical, physiological, mental, economic, cultural or social identity.<\/li>\n<\/ul>\n<p>! For the purposes of this policy, the personal data that will be processed may refer to: name, surname, telephone number, e-mail address, as well as any other information that you provide to us by filling in the available forms. on the website.<\/p>\n<ul>\n<li>&#8220;<strong><em>Processing of personal data<\/em><\/strong>&#8221; means any operation or set of operations performed on personal data, by automatic or non-automatic means, such as collecting, recording, organizing, storing, adapting or modifying, extracting, consulting, using, disclosure to third parties by transmission, dissemination or otherwise, joining or combining, blocking, deleting or destroying.<\/li>\n<\/ul>\n<p>! For the purposes of this policy, data processing refers to those processing performed at the time of your browsing on the website www.cristim.ro, filling in the forms available on the site or subscribing to our newsletter.<\/p>\n<ul>\n<li>\u201e<strong><em>Controller<\/em><\/strong>\u201d means the person who, alone or together with others, establishes the purposes and means of processing personal data. For the sake of clarity, for the purposes of this Privacy Policy, the Controller is represented by Cristim.<\/li>\n<li>\u201e<strong><em>Data subject<\/em><\/strong>\u201d represents the person whose personal data are processed. In the context of this Policy, the data subject is the user\/ visitor of the site <a href=\"https:\/\/cristim-local.local\">cristim.ro<\/a>.<\/li>\n<li>\u201e<strong><em>Consent<\/em><\/strong>\u201d of the data subject means any manifestation of free will, specific, informed and unambiguous of the data subject by which he accepts, by a statement or by an unequivocal action, that the personal data concerning him to be processed.<\/li>\n<\/ul>\n<p>! Regarding the consent, as a legal basis based on which Cristim may process personal data belonging to the data subject who browses its website, it will be granted, respectively requested in the context of the user&#8217;s subscription to the newsletter, following that the data processing that exceeds the subscriptions to be made on the basis of the grounds specified below.<\/p>\n<ul>\n<li>\u201c<strong><em>Third party<\/em><\/strong>\u201d means the natural or legal person, public authority, agency or body other than the data subject, the controller, the processor and the persons who, under the direct authority of the controller or the processor, are authorized to process personal data.<\/li>\n<li>\u201e<strong><em>Processor<\/em><\/strong>\u201d means the person who processes personal data on behalf of the controller.<\/li>\n<li>\u201e<strong><em>Recipient<\/em><\/strong>\u201d means the natural or legal person, public authority, agency or other body to whom personal data are disclosed, whether or not it is a third party. However, public authorities to which personal data may be communicated in the course of a particular investigation in accordance with Union or national law shall not be considered as recipients. The processing of such data by the respective public authorities shall comply with the applicable rules on data protection, in accordance with the purposes of the processing.<\/li>\n<\/ul>\n<h2>3. What types of personal data do we process?<\/h2>\n<p>Your browsing on the website www.cristim.ro and the interaction with it involves the processing of two categories of personal data, namely:<\/p>\n<ol>\n<li>personal data that you disclose to the Controller voluntarily (eg. through the contact form, the recruitment form, the complaints form or by subscribing to the newsletter), these being collected individually;<\/li>\n<li>data that you provide unintentionally, by simply browsing our website.<\/li>\n<\/ol>\n<p>The Controller may collect, based on the voluntary provision of the data subject, the following personal data<strong>: name and surname (for identification), telephone number (for communication), e-mail address (for communication), data contained in the CV for recruitment) and any other personal and special data that the user may make available to Cristim through the forms available on the website.<\/strong><\/p>\n<ul>\n<li>Through the contact form on the site, the Controller will process the following personal data:<strong> name and surname, telephone number, e-mail address, county, as well as any other information that you provide by filling in the &#8220;Message&#8221; box.<\/strong><\/li>\n<\/ul>\n<ul>\n<li>Completing the complaint and notification form involves processing the following categories of data:<strong> name and surname, e-mail address, telephone number, as well as any other data that you provide to the Controller by filling in the &#8220;Message&#8221; field or by uploading video \/ image files.<\/strong><\/li>\n<\/ul>\n<ul>\n<li>Through the recruitment form, the Collector can process the following categories of personal data:<strong> name and surname, e-mail address, telephone number, county, as well as the data contained in the CV uploaded by the candidate who wishes to fill a position within Cristim, but also the data provided by completing the &#8220;Message&#8221; section.<\/strong><\/li>\n<\/ul>\n<ul>\n<li>Last but not least, by subscribing to the user&#8217;s newsletter, Cristim will be able to process a series of personal data such as:<strong> name and surname, e-mail address. <\/strong>The subscription to the newsletter is made only on the basis of obtaining the prior consent of the data subject for the processing of data for this purpose.<\/li>\n<\/ul>\n<p>The user is properly informed about the processing of his personal data when he makes his data available to the Controller through the forms on the website, respectively in the context of subscribing to the newsletter, thus the latter fulfilling its legal obligation to inform data subjects about the processing of data.<\/p>\n<p>The Controller also processes <strong>marketing and communication data, based on user consent, but also technical data and related to browsing actions through cookies and similar technologies. <\/strong>For more information about the cookies used on our website, you can access our cookie policy <a href=\"https:\/\/cristim-local.local\/en\/cookie-policy\/\">here<\/a>.<\/p>\n<p>The Controller manages, besides the online platform <a href=\"https:\/\/cristim-local.local\/\">www.cristim.ro<\/a>, the Facebook page @ Cris-Tim, associated with the site <a href=\"https:\/\/cristim-local.local\/\">www.cristim.ro<\/a>, but also the Instagram page @cristim.ro.<\/p>\n<p>Through the social media pages mentioned above, the Controller can process a series of personal data such as: name\/ nickname &#8211; the name of the social media user profile, if it is not public, data transmitted through messenger\/ message functions, such as and any other information made public voluntarily by the persons concerned through these networks, by the transmission of text, image, audio, video files etc.<\/p>\n<p>In the context of processing this data, the Controller is strictly limited to the expectations of the users of these media channels and does not use the data thus collected for purposes other than statistics or maintaining contact with users (profile\/ page views, likes, follow, story views\/ messages etc.).<\/p>\n<p>Apart from the data collected through the forms available on the site, the Controller may also process other data of the data subjects in his legitimate interest, within the telephone calls made by Cristim staff, including but not limited to the address of residence\/ domicile (for example for delivery of the prizes won after participating in the campaigns organized by the Controller) etc., but also in the context in which it is necessary to make available to the Controller other documents\/ files, which can be sent via e-mail \/ by mail. In general, such processing is performed outside the online platform, which is why specific processing rules will be applied to them, which will not be detailed in this Policy.<\/p>\n<p>Regarding the site, the categories of data processed through it are limited to those listed above. In the event that you send us other data that is not necessary to solve and honor your requests, we reserve the right to remove them from our databases.<\/p>\n<p>The controller may inadvertently collect other personal data that belong to you, namely: IP address, browser version, time zone and location setting, operating system, devices used to access our sites etc. This information will not be used to identify individuals and will not be made public otherwise than under the terms of the Privacy Policy, supplemented by the Cookies Policy.<\/p>\n<p>The controller reserves the right to request additional information, accompanied by supporting documents, by e-mail, printed or in any other way deemed appropriate for it, if applicable.<\/p>\n<p>Your personal data may be communicated by Cristim, for processing, to data controllers or processors, including service providers, business partners, institutions, authorities, competent bodies and institutions or courts, at their request, but also to entities in Controller group.<\/p>\n<p>Cristim may store your personal data even after the registration of a request to delete this data, if the storage is done for one of the following purposes, provided by art. 13 of the GDPR:<\/p>\n<ol>\n<li>fulfillment of a legal obligation that provides for processing under European Union law or domestic law applicable to the controller;<\/li>\n<li>exercising the right to free expression and information;<\/li>\n<li>protecting the vital interests of the data subjects;<\/li>\n<li>fulfilling a task that serves the public interest;<\/li>\n<li>archiving in the public interest, scientific or historical research or for statistical purposes;<\/li>\n<li>the protection of the legitimate interests of the Controller or of a third party, unless the interests or fundamental rights and freedoms of the data subject prevail, which require the protection of personal data, especially when the data subject is a child;<\/li>\n<li>for stating, exercising or defending a right in court.<\/li>\n<\/ol>\n<h2>4. For what purpose do we process personal data?<\/h2>\n<p>The controller processes your personal data for the following purposes and having the following legal grounds:<\/p>\n<ol>\n<li>processing is necessary <strong>for the performance of a contract <\/strong>to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract (Article 6 paragraph (1) letter b) of Regulation (EU) no. 679\/2016 of the European Parliament and of the Council of April 27, 2016, specifically, for the purpose of recruiting staff for a position within Cristim and for concluding an individual employment contract between the data subject and the Controller, as employer;<\/li>\n<li>the data subject has given consent to the processing of his or her personal data (Article 6 paragraph (1) letter a) of Regulation (EU) no. 679\/2016 of the European Parliament and of the Council of April 27, 2016, in case of transmission of marketing communications;<\/li>\n<li>Processing is necessary for the purposes of the <strong>legitimate interest<\/strong> pursued by the Controller (Article 6 paragraph (1) letter f) of Regulation (EU) no. 679\/2016 of the European Parliament and of the Council of April 27, 2016, for solving problems of any kind regarding the content of the site www.cristim.ro and for the actions that involve the interaction with the online platform, but also in order to solve the requests and complaints of the users related to Cristim products and services.<\/li>\n<\/ol>\n<p>Your personal data will be processed by the Controller for the following purposes:<\/p>\n<ol>\n<li>solving the notifications and complaints submitted to the Controller;<\/li>\n<li>providing answers and additional information regarding Cristim offers and products;<\/li>\n<li>delivery\/ replacement of products for which customers have expressed dissatisfaction;<\/li>\n<li>registration of the application for employment within the Controller;<\/li>\n<li>registration in promotions\/ contests\/ campaigns;<\/li>\n<li>designating and informing the winning participants within the campaigns and contests organized by Cristim;<\/li>\n<li>improving the services provided on the cristim.ro platform;<\/li>\n<li>the transmission of the prizes won as a result of participating in the Controller&#8217;s campaigns and the organization of the payment of the taxes related to them, if applicable;<\/li>\n<li>making statistical reports, in legitimate interest;<\/li>\n<li>transmission of marketing communications (newsletters regarding the Controller&#8217;s offers and products) based on free, specific, informed, unequivocal and explicit consent given by the user;<\/li>\n<li>the transmission of requested information, at the request of the competent authorities, in order to fulfill the legal obligations incumbent on the controllers;<\/li>\n<li>archiving information in order to demonstrate the processing of data exclusively for the above-mentioned purposes;<\/li>\n<li>protection of the controller&#8217;s rights.<\/li>\n<\/ol>\n<h2>5. Duration of personal data processing<\/h2>\n<p>The personal data processed at the level of the Controller through the website www.cristim.ro are retained for a reasonable period of time in relation to the purpose of data processing so as not to exceed the period necessary for their processing, depending on the type of data thus processed.<\/p>\n<p>The usual data processing for which there is no retention period imposed by law will be related to the general limitation period of 3 years as the maximum duration of storage in the databases belonging to the Controller.<\/p>\n<p>Regarding the processing based on consent, the data will be retained until the moment of withdrawal of consent, but their duration of retention will not exceed the general limitation period indicated above.<\/p>\n<h2>6. Transfer of personal data<\/h2>\n<p>Your data is processed throughout the European Union, through secure internal servers.<\/p>\n<p>Cristim undertakes that the data collected by it will be processed only in accordance with the stated purposes and not to make it public, to sell, rent, license, transfer etc. unauthorized database containing information regarding the data of the persons concerned to any third party not involved in the fulfillment of the declared purposes, except for the situation in which the transfer\/ access\/ view etc.\u00a0 is requested by the competent bodies, in the cases provided by the regulations in force at the date of the event.<\/p>\n<p>It is possible that your data may be disclosed to the entities in the Controller group, together with which Cristim processes the data as an joint controller, to the service providers of the joint Controllers (marketing, courier, payment\/ banking services, telemarketing or other services), including entities that assist the Controller in data processing as proxies, insurers, public authorities (lawyers, Prosecutor&#8217;s Office, Police, courts and other competent state bodies), based on and within the limits of legal provisions and as a result of express requests formulated in this sense. This data will be transferred only on the basis of a confidentiality commitment from the above-mentioned recipients, by which they guarantee that the data is kept secure and that the provision of this personal information is made in accordance with the legislation in force.<\/p>\n<p>These entities are carefully selected to ensure that they meet the specific requirements for the protection of personal data. They have a limited ability to use your information for other purposes than providing us with services.<\/p>\n<p>In addition to the disclosures described in this Privacy Policy, we may disclose information to third parties to whom you consent or request that such disclosures be made.<\/p>\n<h2>7. Special provisions for minors<\/h2>\n<p>Cristim pays special attention to the data of minors that may be provided by them in the context of interaction with the website www.cristim.ro, to ensure that any processing of personal data of minors is done only in accordance with legal requirements and in strictly determined cases.<\/p>\n<p>Thus, the Controller does not carry out promotional and marketing activities directly against minors. However, if a minor contacts the Controller through the means provided by him (by phone, via e-mail, through the website etc.), it will be considered that the minor has done so with the consent of his legal representative.<\/p>\n<p>Minors who have not reached the age of 14 are not allowed to request services or participate in contests or campaigns organized by the Controller, unless these operations are performed on behalf of the minor by the legal representative or guardian, according to law.<\/p>\n<p>In this sense, any person who provides Cristim with personal data through the site or other applications or devices covered by this Policy guarantees that he is of age, respectively that he has full capacity to exercise.<\/p>\n<p>Any processing of personal data belonging to minors will be carried out only in accordance with the law and taking into account the above provisions.<\/p>\n<h2>8. Links, hyperlinks, third party websites<\/h2>\n<p>The www.cristim.ro site may contain links to third party sites that may collect, in turn, your personal data, including through cookies or other similar technologies. In case of connection to a third party website, the Controller&#8217;s privacy policy will not be applicable in case of your browsing on that site.<\/p>\n<h2>9. What are your rights as a data subject?<\/h2>\n<p>Any natural person who browses our site, as a data subject, has the following rights in relation to Cristim, as a Personal Data Controller:<\/p>\n<ul>\n<li><strong>Right of access<\/strong> means the right of the data subject to obtain from the controller confirmation as to whether or not personal data concerning him or her are being processed and, where that is the case, access to the respective data and to information regarding the way in which the data are processed.<\/li>\n<li><strong>Right to rectification<\/strong> refers to the right to obtain from the controller without undue delay the rectification of inaccurate personal data concerning him or her, having the right to have incomplete personal data completed. These can be modified by sending an e-mail to: dpo@cristim.ro.<\/li>\n<li><strong>Right to erasure (\u2018right to be forgotten\u2019) <\/strong>of data from the database means he right of the data subject to request that his \/ her personal data be deleted, without undue delay, if one of the following grounds applies: the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed, the data subject withdraws consent on which the processing is based and there is no other legal ground for the processing, \u00a0the data subject objects to the processing and there are no overriding legitimate grounds for the processing, the personal data have been unlawfully processed, the personal data have to be erased for compliance with a legal obligation, the personal data have been collected in relation to the offer of information society services.<\/li>\n<li><strong>Right to restriction of processing <\/strong>may be exercised if the data subject requests the limitation of the processing of his \/ her personal data, in which case they will be used strictly for the exercise of the other legal rights of the data subject, including to respond to any requests \/ complaints from him \/ her.<\/li>\n<li><strong>Right to data portability<\/strong> refers to the right to receive the personal data concerning him or her, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided, where the processing is based on consent or on a contract. The processing is carried out by automated means, if this is technically feasible.<\/li>\n<li><strong>Right to object <\/strong>concerns the right of the data subject to oppose the processing of personal data when the processing is necessary for the performance of a task that serves a public interest or when it has in view a legitimate interest of Cristim.<\/li>\n<li><strong>Right to object to automated individual decision-making, including profiling <\/strong>refers to the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or similarly significantly affects him or her. However, the exercise of this right shall not apply if the decision is necessary for entering into, or performance of, a contract between the data subject and a data controller, if the decision is authorized by the law to which the controller is subject and which also lays down suitable measures to safeguard the data subject&#8217;s rights and freedoms and legitimate interests or if the decision is based on the data subject&#8217;s explicit consent obtained in compliance with the legislation in force.<\/li>\n<li>The right to address the National Authority for the Supervision of Personal Data Processing. Cu toate acestea, autorit\u0103\u021bile publice c\u0103rora li se pot comunica dat cu caracter personal \u00een cadrul unei anumite anchete, \u00een conformitate cu dreptul Uniunii sau cu dreptul intern, nu sunt considerate destinatari. personal:\u00a0<strong>nume <\/strong><strong>\u0219<\/strong><strong>i prenume, adresa de e-mail, num<\/strong><strong>\u0103<\/strong><strong>r de telefon, jude<\/strong><strong>\u021b<\/strong><strong>,<\/strong><strong>\u00a0<\/strong>precum \u0219i<strong>\u00a0datele con<\/strong><strong>\u021b<\/strong><strong>inute prelucr\u0103rii acestor date, Operatorul se limiteaz\u0103 strict la a\u0219tept\u0103rile utilizatorilor acestor canale media \u0219i nu utilizeaz\u0103 datele astfel colectate \u00een alte scopuri dec\u00e2t cele de statistic\u0103 sau de men\u021binere a leg\u0103turii cu utilizatorii (vizualiz\u0103ri profil\/ pagin\u0103, like-uri, follow, vizualiz\u0103ri story-uri\/mesaje etc.).<\/p><p>Distinct de datele colectate prin formularele disponibile pe site, Operatorul poate prelucra \u0219i alte date ale persoanelor vizate \u00een interesul legitim al acestuia, \u00een cadrul apelurilor telefonice efectuate de personalul Cristim, incluz\u00e2nd, dar nelimitandu-se la adresa de re\u0219edin\u021ba\/ domiciliu (spre exemplu pentru livrarea premiilor c\u00e2\u0219tigate \u00een urm\u0103 particip\u0103rii la campaniile organizate de Operator) etc., dar \u0219i \u00een contextul \u00een care este necesar\u0103 punerea la dispozi\u021bia Operatorului \u0219i a altor documente\/ fi\u0219iere, care pot fi transmise\u00a0<em>via<\/em>\u00a0e-mail\/ prin po\u0219t\u0103. \u00cen general, astfel de prelucr\u0103ri se realizeaz\u0103 dec\u00e2t \u00een condi\u021biile inserate \u00een Politic\u0103 de Confidentialite, completat\u0103 cu\u00a0Politic\u0103 de Cookies.<\/p><p>Operatorul \u00ee\u0219i rezerv\u0103 dreptul de a va solicit\u0103 informa\u021b\u00eei suplimentare, \u00eenso\u021bite de documente doveditoare, prin intermediul e-mailului, tip\u0103rite sau \u00een orice alt mod considerat oportun pentru acesta, dac\u0103 va fi cazul.<\/p><p>Datele dumneavoastr\u0103 cu caracter personal pot fi comunicate de Cristim, \u00een vederea prelucr\u0103rii, unor persoane \u00eemputernicite cu prelucrarea datelor, inclusiv furnizorilor de servicii, partenerilor comerciali, institu\u021biilor, autorit\u0103\u021bilor, organismelor \u0219i institu\u021biilor competen\u021be sau instan\u021belor judec\u0103tore\u0219\u021bi, la solictarea acestora, dar \u0219i entit\u0103\u021bilor din grupul Operatorului.<\/p><p>Cristim poate stoca datele dumneavoastr\u0103 personale chiar \u0219i dup\u0103 \u00eenregistrarea unei cereri de \u0219tergere a acestor date, dac\u0103 stocarea se face \u00een unul din urm\u0103toarele scopuri, prev\u0103zute de art. 13 din GDPR:<\/p><ol><li>a)\u00eendeplinirea unei oblig\u0103\u021b\u00eei legale care prevede prelucrarea \u00een temeiul dreptului Uniunii Europene sau al dreptului intern care se aplic\u0103 operatorului;<\/li><li>b)exercitarea dreptului la liber\u0103 exprimare \u0219i la informare;<\/li><li>c)protejarea intereselor vitale ale persoanelor vizate;<\/li><li>d)\u00eendeplinirea unei sarcini care serve\u0219te interesului public;<\/li><li>e)arhivare \u00een interes public, cercetare \u0219tiin\u021bific\u0103 sau istoric\u0103 ori \u00een scopuri statistice;<\/li><li>f)ap\u0103rarea intereselor legitime ale Operatorului sau ale unei p\u0103r\u021bi ter\u021be, cu excep\u021bia cazului \u00een care prevaleaz\u0103 interesele sau drepturile \u0219i libert\u0103\u021bile fundamentale ale persoanei vizate, care necesit\u0103 protejarea datelor cu caracter personal, \u00een special atunci c\u00e2nd persoan\u0103 vizat\u0103 este un copil;<\/li><li>g)pentru constatarea, exercitarea sau ap\u0103rarea unui drept \u00een instan\u021b<\/li><\/ol><p>\u00a0<\/p><h3>4. \u00cen ce scop prelucr\u0103m datele personale?<\/h3><p><strong>\u00a0<\/strong><\/p><p>Operatorul prelucreaz\u0103 datele dumneavoastr\u0103 cu caracter personal \u00een urm\u0103toarele scopuri \u0219i av\u00e2nd urm\u0103toarele temeiuri legale:<\/p><ol><li>a)prelucrarea este necesar\u0103\u00a0<strong>pentru executarea unui contract <\/strong>la care persoan\u0103 vizat\u0103 este parte sau pentru a face demersuri la cererea persoanei vizate \u00eenainte de \u00eencheierea unui contract (art. 6 alin. (1) lit. b) din Regulamentul (UE) nr. 679\/ 2016 al Parlamentului European \u0219i al Consiliului din 27 aprilie 2016), \u00een concret, \u00een scopul\u00a0recrut\u0103rii de personal pentru ocuparea unui post \u00een cadrul Cristim \u0219i pentru \u00eencheierea unui contract individual de munc\u0103 \u00eentre persoan\u0103 vizat\u0103 \u0219i Operator, \u00een calitate de angajator;<\/li><li>b)prelucrarea este efectuat\u0103 \u00een temeiul\u00a0<strong>consimtam\u00e2ntului\u00a0<\/strong>persoanelor vizate (art. 6, alin. (1), lit. a) din Regulamentul (UE) nr. 679\/ 2016 al Parlamentului European \u0219i al Consiliului din 27 aprilie 2016), \u00een cazul transmiterii de comunic\u0103ri de marketing;<\/li><li>c)prelucrarea este necesar\u0103 \u00een scopul\u00a0<strong>intereselor legitime <\/strong>urm\u0103rite de operator (art. 6 alin. (1) lit. f) din Regulamentul (UE) nr. 679\/ 2016 al Parlamentului European \u0219i al Consiliului din 27 aprilie 2016),\u00a0pentru rezolvarea problemelor de orice natur\u0103 referitoare la con\u021binutul site-ului www.cristim.ro \u0219i pentru ac\u021biunile care implic\u0103 interac\u021biunea cu plaftorma online, dar \u0219i \u00een scopul solu\u021bion\u0103rii solicit\u0103rilor \u0219i reclama\u021biilor utilizatorilor legate de produsele \u0219i serviciile Cristim.<\/li><\/ol><p>Datele dumneavoastr\u0103 personale vor fi prelucrate de Operator \u00een urm\u0103toarele scopuri:<\/p><ol><li>a)solu\u021bionarea sesiz\u0103rilor \u0219i reclama\u021biilor \u00eenaintate Operatorului;<\/li><li>b)oferirea de r\u0103spunsuri \u0219i informa\u021b\u00eei suplimentare cu privire la ofertele \u0219i produsele Cristim;<\/li><li>c)livrarea\/\u00eenlocuirea produselor fa\u021b\u0103 de care clientii \u0219i-au exprimat nemultumirea;<\/li><li>d)\u00eenregistrarea aplic\u0103\u021biei pentru ocuparea unui loc de munc\u0103 \u00een cadrul Operatorului;<\/li><li>e)\u00eenscrierea \u00een promotii\/ concursuri\/ campanii;<\/li><li>f)desemnarea\u00a0\u0219i informarea participantilor castigatori din cadrul campaniilor\u00a0\u0219i concursurilor organizate de Cristim;<\/li><li>g)\u00eembun\u0103t\u0103\u021birea serviciilor furnizate pe platforma\u00a0<a href=\"https:\/\/www.cristim.ro\/\" target=\"_blank\" rel=\"noopener\">cristim.ro<\/a>;<\/li><li>h)transmiterea premiilor c\u00e2\u0219tigate \u00een urm\u0103 particip\u0103rii la campaniile Operatorului \u0219i organizarea pl\u0103\u021b\u00eei impozitelor aferente acestora, dac\u0103 este cazul;<\/li><li>i)realizarea de rapoarte statistice, \u00een interes legitim;<\/li><li>j)transmiterea de comunic\u0103ri de marketing (buletine informative privind ofertele \u0219i produsele Operatorului) pe baza de consim\u021b\u0103m\u00e2nt liber, specific, informat, neechivoc \u0219i explicit acordat de utilizator;<\/li><li>k)transmiterea de informa\u021b\u00eei solicitate, la cererea autorit\u0103\u021bilor competen\u021be, \u00een vederea \u00eendeplinirii oblig\u0103\u021biilor legale ce le revin operatorilor;<\/li><li>l)arhivarea informa\u021biilor \u00een vederea demonstr\u0103rii prelucr\u0103rii datelor exclusiv \u00een scopurile sus-men\u021bionate;<\/li><li>m)protejarea drepturilor Operatorului.<\/li><\/ol><p>\u00a0<\/p><h3>5. Durata prelucr\u0103rii datelor cu caracter personal<\/h3><p><strong>\u00a0<\/strong><\/p><p>Datele cu caracter personal prelucrate la nivelul Operatorului prin intermediul website-ului www.cristim.ro sunt re\u021binute pe o perioada de timp rezonabil\u0103 raportat la scopul prelucr\u0103rii datelor astfel \u00eenc\u00e2t s\u0103 nu se dep\u0103\u0219easc\u0103 perioada necesar\u0103 prelucr\u0103rii lor, \u00een func\u021bie de tipologia datelor astfel prelucrate.<\/p><p>Prelucr\u0103rile uzuale de date pentru care nu exist\u0103 o durata de reten\u021bie impus\u0103 de lege se vor raporta la termenul general de prescrip\u021bie de 3 ani c\u0103 durata maxim\u0103 aferent\u0103 stoc\u0103rii \u00een bazele de date apar\u021b\u00een\u00e2nd Operatorului.<\/p><p>\u00cen ceea ce prive\u0219te prelucr\u0103rile pe baza de consim\u021b\u0103m\u00e2nt, datele vor fi re\u021binute p\u00e2n\u0103 la momentul retragerii consimtam\u00e2ntului, \u00eens\u0103 durata acestora de reten\u021bie nu va dep\u0103\u0219i termenul general de prescrip\u021bie indicat mai sus.<\/p><h3>6. Transferul de date cu caracter personal<\/h3><p><strong>\u00a0<\/strong><\/p><p>Datele dumneavoastr\u0103 sunt prelucrate pe teritoriul Uniunii Europene, prin intermediul unor servere interne securizate.<\/p><p>Cristim se oblig\u0103 c\u0103 datele colectate de acesta s\u0103 fie prelucrate numai \u00een conformitate cu scopurile declarate \u0219i s\u0103 nu fac\u0103 public\u0103, s\u0103 v\u00e2nd\u0103, \u00eenchirieze, licen\u021bieze, transfere etc. neautorizat baza de date con\u021b\u00een\u00e2nd informa\u021b\u00eei referitoare la datele persoanelor vizate vreunui ter\u021b neimplicat \u00een \u00eendeplinirea scopurilor declarate, cu excep\u021bia situa\u021biei \u00een care transferul\/accesarea\/vizualizarea etc. este cerut\/a de c\u0103tre organele abilitate, \u00een cazurile prev\u0103zute de reglement\u0103rile \u00een vigoare la dat\u0103 producerii evenimentului.<\/p><p>Este posibil c\u0103 datele dumneavoastr\u0103 s\u0103 fie dezv\u0103luite c\u0103tre entit\u0103\u021bile din grupul Operatorului, \u00eempreun\u0103 cu care Cristim prelucreaz\u0103 datele \u00een calitate de operator asociat, c\u0103tre furnizorii de servicii ai Operatorilor asocia\u021bi (de marketing, curierat, servicii de plata\/ bancare, telemarketing sau alte servicii), inclusiv entit\u0103\u021bi care asista Operatorul \u00een prelucrarea de date \u00een calitate de \u00eemputernici\u021bi, asigur\u0103tori, autorit\u0103\u021bi publice (avoca\u021bi, Parchet, Poli\u021bie, instan\u021bele judec\u0103tore\u0219\u021bi \u0219i altor organe abilitate ale statului), \u00een baza \u0219i \u00een limitele prevederilor legale \u0219i c\u0103 urmare a unor cereri expres formulate \u00een acest sens. Aceste date vor fi transferate numai \u00een temeiul unui angajament de confiden\u021bialitate din partea destinatarilor sus \u2013 men\u021biona\u021bi, prin care ace\u0219\u021bia garanteaz\u0103 c\u0103 datele sunt p\u0103strate \u00een siguran\u021b\u0103 \u0219i c\u0103 furnizarea acestor informa\u021b\u00eei personale se face conform legisla\u021biei \u00een vigoare.<\/p><p>Aceste entit\u0103\u021bi sunt selectate cu o grij\u0103 deosebit\u0103 pentru a ne asigura c\u0103 \u00eendeplinesc cerin\u021bele specifice \u00een materie de protec\u021bie a datelor cu caracter personal. Acestea au o capacitate limitat\u0103 de a utiliza informa\u021biile dumneavastra \u00een alte scopuri dec\u00e2t cel de a ne furniza servicii.<\/p><p>\u00cen afar\u0103 dezv\u0103luirilor descrise \u00een prezen\u021ba Politic\u0103 de confiden\u021bialitate, este posibil s\u0103 transmitem informa\u021b\u00eei ter\u021bilor c\u0103rora consim\u021bi sau solici\u021bi s\u0103 efectu\u0103m o asemenea dezv\u0103luire.<\/p><p>\u00a0<\/p><h3><strong>7.Prevederi speciale legate de minori<\/strong><\/h3><p>\u00a0<\/p><p>Cristim acord\u0103 o aten\u021bie deosebit\u0103 \u00een ceea ce prive\u0219te datele minorilor care ar putea fi furnizate de ace\u0219\u021bia \u00een contextul interac\u021biunii cu website-ul www.cristim.ro, pentru a se asigura c\u0103 orice prelucrare a datelor cu caracter personal ale minorilor se realizeaz\u0103 numai \u00een conformitate cu cerin\u021bele legale \u0219i \u00een cazuri strict determinate.<\/p><p>Astfel, Operatorul nu realizeaz\u0103 activit\u0103\u021bi promo\u021bionale \u0219i de marketing direct fa\u021b\u0103 de minori. Cu toate acestea, dac\u0103 un minor contacteaz\u0103 Operatorul prin modalit\u0103\u021bile puse la dispozi\u021bie de acesta (telefonic,\u00a0<em>via\u00a0<\/em>e-mail, prin intermediul site-ului etc.), se va consider\u0103 c\u0103 minorul a f\u0103cut acest demers cu acordul reprezentantului sau legal.<\/p><p>Minorilor care nu au \u00eemplinit v\u00e2rst\u0103 de 14 ani nu li se permite solicitarea de servicii ori participarea la concursuri sau campanii organizate de Operator, dec\u00e2t dac\u0103 aceste opera\u021biuni se realizeaz\u0103 \u00een numele minorului de c\u0103tre reprezentantul legal sau tutorele acestuia, conform legii.<\/p><p>\u00cen acest sens, orice persoan\u0103 care furnizeaz\u0103 c\u0103tre Cristim datele personale prin intermediul site-ului sau al altor aplic\u0103\u021b\u00eei sau dispozitive acoperite de prezen\u021ba Politic\u0103 garanteaz\u0103 faptul c\u0103 este major, respectiv c\u0103 de\u021bine capacitate deplin\u0103 de exerci\u021biu.<\/p><p>Orice prelucrare de date cu caracter personal apar\u021b\u00een\u00e2nd minorilor se va realiza numai \u00een condi\u021biile legii \u0219i av\u00e2nd \u00een vedere prevederile de mai sus.<\/p><p>\u00a0<\/p><h3>8. Link-uri, hyperlink-uri, site-uri ter\u021be<\/h3><p>\u00a0<\/p><p>Site-ul\u00a0<a href=\"https:\/\/www.cristim.ro\/\" target=\"_blank\" rel=\"noopener\">www.cristim.ro<\/a>\u00a0poate con\u021bine link-uri c\u0103tre site-uri ter\u021be ce pot colecta, la r\u00e2ndul lor, datele dumneavoastr\u0103 cu caracter personal, inclusiv prin intermediul cookie-urilor sau altor tehnologii similare. \u00cen cazul conect\u0103rii la un site web ter\u021b, politic\u0103 de confiden\u021bialitate a Operatorului nu va fi aplicabil\u0103 \u0219i \u00een cazul navig\u0103rii dumneavoastr\u0103 pe acel site.<\/p><h3>9. Care sunt drepturile pe care le de\u021bine\u021bi \u00een calitate de persoan\u0103 vizat\u0103?<\/h3><p><strong>\u00a0<\/strong><\/p><p>Orice persoan\u0103 fizic\u0103 care navigheaz\u0103 pe site-ul nostru, \u00een calitate de persoan\u0103 vizat\u0103, are urm\u0103toarele drepturi \u00een raport cu Cristim, c\u0103 Operator de date cu caracter personal:<\/p><ul><li><strong>Dreptul la acces<\/strong>\u00a0\u00eenseamn\u0103 dreptul persoanei vizate de a ob\u021bine o confirmare din partea Operatorului c\u0103 acesta prelucreaz\u0103 sau nu datele cu caracter personal care o privesc \u0219i, \u00een caz afirmativ, acces la datele respective \u0219i la informa\u021b\u00eei privind modalitatea \u00een care sunt prelucrate datele.<\/li><li><strong>Dreptul la rectificare<\/strong>\u00a0se refer\u0103 la corectarea, f\u0103r\u0103 \u00eent\u00e2rzieri nejustificate, a datelor cu caracter personal inexacte prelucrate sau la completarea acestora, \u00een cazul \u00een care sunt incomplete. Acestea pot fi modificate prin transmiterea unui e-mail la adresa: dpo@cristim.ro.<\/li><li><strong>Dreptul la eliminarea datelor\/ dreptul la <\/strong><strong>\u0219<\/strong><strong>tergerea<\/strong>\u00a0acestora din baza de date \u00eenseamn\u0103 dreptul persoanei vizate de a solicit\u0103 s\u0103 \u00eei fie \u0219terse datele cu caracter personal, f\u0103r\u0103 \u00eent\u00e2rzieri nejustificate, \u00een cazul \u00een care se aplic\u0103 unul dintre urm\u0103toarele motive: acestea nu mai sunt necesare pentru \u00eendeplinirea scopurilor pentru care au fost colectate sau prelucrate, persoan\u0103 vizat\u0103 \u00ee\u0219i retrage consim\u021b\u0103m\u00e2ntul \u0219i nu exist\u0103 niciun alt temei juridic pentru prelucrare, persoan\u0103 vizat\u0103 se opune prelucr\u0103rii \u0219i nu exist\u0103 motive legitime care s\u0103 prevaleze, datele cu caracter personal au fost prelucrate ilegal, datele cu caracter personal trebuie \u0219terse pentru respectarea unei oblig\u0103\u021b\u00eei legale, datele cu caracter personal au fost colectate \u00een leg\u0103tur\u0103 cu oferirea de servicii ale societ\u0103\u021b\u00eei.<\/li><li><strong>Dreptul la restric<\/strong><strong>\u021b<\/strong><strong>ionarea prelucr<\/strong><strong>\u0103<\/strong><strong>rii<\/strong>\u00a0poate fi exercitat \u00een cazul \u00een care persoan\u0103 vizat\u0103 solicit\u0103 limitarea prelucr\u0103rii datelor sale cu caracter personal, caz \u00een care acestea vor fi utilizate strict pentru exercitarea celorlalte drepturi legale ale persoanei vizate, inclusiv pentru a r\u0103spunde la orice solicit\u0103ri\/ reclama\u021b\u00eei din partea acesteia.<\/li><li><strong>Dreptul la portabilitate<\/strong>\u00a0se refer\u0103 la dreptul de a primi datele personale \u00eentr-un format structurat, utilizat \u00een mod curent \u0219i care poate fi citit automat \u0219i la dreptul c\u0103 aceste date s\u0103 fie transmise direct altui operator, atunci c\u00e2nd prelucrarea are c\u0103 temei consim\u021b\u0103m\u00e2ntul sau executarea unui contract \u0219i se efectueaz\u0103 prin mijloace automatizate, dac\u0103 acest lucru este fezabil din punct de vedere tehnic.<\/li><li><strong>Dreptul la opozi<\/strong><strong>\u021b<\/strong><strong>ie<\/strong>\u00a0vizeaz\u0103 dreptul persoanei vizate de a se opune prelucr\u0103rii datelor personale atunci c\u00e2nd prelucrarea este necesar\u0103 pentru \u00eendeplinirea unei sarcini care serve\u0219te unui interes public sau c\u00e2nd are \u00een vedere un interes legitim al Cristim.<\/li><li><strong>Dreptul de a se opune la prelucrarea datelor \u00een baza unor decizii individuale automate<\/strong>\u00a0se refer\u0103 la faptul c\u0103 persoan\u0103 vizat\u0103 are dreptul de a nu face obiectul unei decizii bazate exclusiv pe prelucrarea automat\u0103, inclusiv crearea de profiluri, care produce efecte juridice care privesc persoan\u0103 vizat\u0103 sau o afecteaz\u0103 \u00een mod similar \u00eentr-o m\u0103sur\u0103 semnificativ\u0103.
